房子租借合同

PREMISES LEASE CONTRACT

本合同两方当事人

Parties hereto

出租方(甲方):

Lessor(hereinafter referred to as Party A):

承租方(乙方):

Lessee(hereinafter referred to as Party B):

依据国家有关法律、法例和本市有关规定,甲、乙两方在同样自发的基础上,经友善磋商一致,就甲方将其合法拥有的房子出租给乙方使用,乙方承租使用甲方房子事宜,订立本合同。

Party A and B have, in respect of leasing the legitimate premises owned by Party A to Party B,reached an agreement through friendly consultation to conclude the following contract under the relevant national laws and regulations, as well as the relevantstipulationsof the city.

一、建物地点

1. Location of the premises

甲方将其所有的位于 ___市___区____________的房子及其隶属设备在优秀

状态下出租给乙方 _____使用。

Party A will lease to Party B the premises and attached facilities owned by itself which is located at (Location) and in good condition for.

二、房子面积

2. Size of the premises

出租房子的登记面积为平方米(建筑面积)。

The registered size of the leased premises is square meters (Gross size).

三、租借限期

3. Lease term

租借限期自 ___年___月___日起至 ____年___月__日止,租期为期 ___年,

甲方应于 ___年___月___日将房子凌空并交托乙方使用。

The lease term will be from___(month) ___(day) ___(year)to ___

( month) ___(day)___(year), Lease Term year(s).Party A will clear the

premises and provide it to Party B for use before___(month )___(day)____

( year).

四、租金

4.

Rental

1. 数额:

两方商定租金为每个月 ______元整(含管理费)。乙方以现金形式支付给甲

方。

1)Amount:

the rental will be ____RMB per month (includingmanagement fees). Party B will

pay the rental to Party A in the form of cash.

2.租金按月为壹期支付;第一期租金于 ___年___月___日从前付清;此后每

期租金于每个月的日从前缴纳,先付后住(若乙方以汇款形式支付租金,则以汇出日为支付日,汇费由汇出方肩负);甲方收到租金后予书面签收。

2)Payment of rental will be one installment every month(s). The first installment will be paid before ___(month )___(day)___(year).Each successive installment will be paid by (date) of each month. Party B will pay the

rental before using the premises and attached facilities ( In case Party B pays the rental in the form of remittance, the date ofremitting will be the day of payment and the remittance fee will be borne by the remitter. ) Party A will issue a written receipt after receiving the payment.

3.如乙方逾期支付租金超出七天,则每日以月租金的

0.3%支付滞纳金;如乙方逾期支付租金超出十天,则视为乙方自动退租,构成违约,甲方有权回收房子,并追查乙方违约责任。

3)Where the rental is more than 7working days overdue,Party B will pay

0.3 percent of monthly rental as overdue fine every day, if the rentalbe paid 10

days overdue, Party B will be deemed to have withdrawn from the premises and breach the contract. In this situation, Party A has the right to take back the premises

and take actions against party B ‘ s breach.

五、押金

5. Deposit

1.为保证房子及其隶属设备之安全与完满,及租借期内有关花费之按期结

算,乙方赞同于 ___年___月___日前支付给甲方押金 ____元整,甲方在收到押金

后予以书面签收。

1)Guarantying the safety and good conditions of the premises and attached facilities and account of relevant fees are settled on schedule during the lease term, party B shall pay to party A as a deposit before __(month )(day)___

( year).Party A shall issue a written receipt after receiving the deposit.

2.除合同还有商定外,甲方应于租借关系除去且乙方迁空、点清并付清所有对付花费后的当日将押金全额无息退还乙方。

2) Unless otherwise provided for by this contract, Party A will returnfull amount of the deposit without interest on

the day when this contract expires and party B clears the premises and has paid all due rental and other expenses.

3.因乙方违犯本合同的规定而产生的违约金、破坏补偿金和其余有关花费,甲方可在押金中抵扣,不足部分乙方一定在接到甲方付款通知后十天内补足。

六、甲方义务

6. Obligations of Party A

1.甲方须准时将房子及隶属设备(详见附件)交托乙方使用。

1)Party A will provide the premises and attached facilities (see the appendix of furniture list for detail ) on schedule to Party B forusing.

2.房子设备如因质量原由、自然消耗、不行抗力或不测事件而遇到破坏,甲

方有修葺并肩负有关花费的责任。如甲方未在两周内修复该破坏物,致使乙方没法正常使用房子设备,乙方有权停止该合约,并要求退还押金。

2)In case the premise and attached facilities are damaged by quality problems, natural damages or accidents, Party A will be responsible to repair and pay the

relevant expenses.If Party A can ‘ t repair the damaged facilities in two weeks so th Party B can ’ t use the facilities normally,PartyB has the right to terminate the contract and Party A must return the deposit.

3.甲方应保证出租的房子享有出租的权益,如租借期内该房子发生所有权全

部或部分转移、设定他项物权或其余影响乙方权益的事件,甲方应保证所有权人、他项权益人或其余影响乙方权益的第三者能持续恪守本合同所有条款,反之如乙方权益所以遭到伤害,甲方应负补偿责任。

3)Party A will guarantee the lease right of the premise. In case of occurrence of ownership transfer in whole or in part and other accidents affecting the right of lease by party

4.甲方应为本合同办理登记存案手续,如因未办理有关登记手续致该合同无

效或伤害乙方租借权益,应由甲方负责补偿,且甲方应肩负该合同有关的所有税费。

4)Party A must register this contract with the relevant government authority If

not doing so resulting that this contract is invalid or Party B ‘ s right o damaged, Party A should take the all responsibilities. Party Ashould also bear the all

the relevant taxes

七、乙方义务

7. Obligations of Party B

1.乙方应按合同的规定准时支付租金及押金。

1)Party B will pay the rental and the deposit on time.

2.乙方经甲方赞同,可在房子内添置设备。租借期满后,乙方将添置的设备搬走,并保证不影响房子的完满及正常使用。

2)Party B may add new facilities with Party A ‘ s approval. When thiscont

expires, Party B may take away the added facilities without changing the good conditions of the premises for normal use.

4.乙方应按本合同规定合法使用该房子,不得私自改变使用性质。乙方不得

在该房子内寄存危险物件。不然,如该房子及隶属设备所以受损,乙方应肩负所有责任。

4)Party B will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials in it. Otherwise, Party B will be responsible for the damages caused by it.

5.乙方应肩负租借期内的水、电、煤气、电话费、收视费、全部因实质使用而产生的花费,并按单按期缴纳。

八、合同停止及排除的规定

8. Termination and dissolution of the contract

1.乙方在租借期满后如需续租,应提早一个月通知甲方,由两方另行磋商续租事宜。在同样条件下乙方享有优先续租权。

1)Within one month before the contract expires,Party B will notify Party A if it intends to extend the lease. In this situation, twoparties will discuss matters over the extension. Under the same terms Party B has the priority to lease the premises.

2.租借期满后,乙方应在日内将房子交还甲方;任何滞留物,如未获得甲方体谅,均视为放弃,听凭甲方处理,乙方决无异议。

2)When the lease term expires, Party B will return the premises and attached facilities to Party A within days. Any belongings left init without Party A's previous understanding will be deemed to be abandoned by Party

B.In this situation,Party A has the right to dispose of it and Party B will raise no objection.

3.本合同一经两方署名后立刻奏效;未经两方赞同,不得随意停止,若有未尽事宜,甲、乙两方可另行磋商。

3)This contract will be effective after being signed by both parties.Any party

has no right to terminate this contract without another party ’ s agreeme not covered in this contract will be discussed separately by both parties.

九、违约及办理

9. Breach of the contract

1.甲、乙两方任何一方在未征得对方体谅的状况下,不执行本合同规定条

款,致使本合同半途停止,则视为该方违约,两方赞同违约金为 ___元整,若违约金不足填补无过失方之损失,则违约方还需就不足部分支付补偿金。

2.若两方在执行本合同或与本合同有关的事情时发生争议,应第一友善磋商;磋商不行,可向有管辖权的人民提起诉讼。

2)Both parties will solve the disputes arising from execution of the contract or in connection with the contract through friendly consultation.In case the agreement cannot be reached,any party may summit the dispute to the court that has the jurisdiction over the matter.

3.本合同一经两方署名后立刻奏效;未经两方赞同,不得随意停止,若有未尽事宜,甲、乙两方可另行磋商。

十、其余

10. Miscellaneous

1.本合同附件是本合同的有效构成部分,与本合同拥有同样法律效劳。

1)Any annex is the integral part of this contract. The annex and this contract are equally valid.

2.本合同壹式贰份,甲、乙两方各执一份。
